Definitions

1.1.    These are the terms and conditions that apply to all products we supply to you, this includes goods and services supplied by any means. Typically, this is by sale, donation or sample.

1.2.    For the purposes of these terms and conditions: “we”, “us”, “our”, “seller” — and other pronouns and nouns used to describe the person, persons or company conveying information — defined as Logwise, Logwise Firewood, G.Taylor, and G and J Taylor.

1.3.    For the purposes of these terms and conditions: “you”, “your”, “consumer”, “customer/s” — and other pronouns and nouns commonly used to describe the person or persons these terms and addressing — are defined as the receiver of goods or services of any kind from “us”.

1.4.    Only retail customers are “consumers”. For the context for these terms and conditions if we use the noun consumer we are only referring to a retail customer.

1.5.    The words writing, written, wrote and all similar verbs includes all forms of written words, including emails.

 

Domestic and commercial customers definitions

2.1.    Some parts of these terms and conditions confer different rights if you are a domestic or commercial customer.

2.2.    You are a consumer if you are buying products for your personal use only.

2.3.    A commercial customer may be buying products to resell.

2.4.    A commercial customer may not claim for innocent or negligent misrepresentation based on any statement in this agreement or from our website.

 

Our contract with you

3.1.    Orders of goods or services are deemed as an offer by you to purchase goods or services from us.

3.2.    Our acceptance of your order will transpire when we email you with an order form clearly titled “Completed”. This action indicates a contract will exist between you and us.

3.3.    A wholesale contract transpires between you and us after you have received an invoice from us and payment of the goods has cleared in our bank account.

3.4.    We will assign an order or invoice number to your order which shall be emailed to you with your invoice and/or “completed” order form.

5.1.    We have done our very best to represent our products accurately and truthfully throughout our website, online and across all other means, this being said, our images are for illustrative purposes only and your goods may differ in appearance and packaging.

5.2.    Whilst we take every care to ensure that the content of this website is accurate, some of the information contained is supplied to us by third parties and as such we are not able to completely verify the accuracy of all the contents. You are advised to independently verify any information contained on this website before acting on it. This applies to all product categories, guidelines on use, storage, volumes, delivery etc.

5.3.    All claims, statements and information contained on our website or in any communication relating to products is true to the best of our knowledge and not legally binding, any disputes or contentions may not claim any misrepresentation. 

5.4.    Goods may arrive in different packaging to what is displayed on the website.

5.5.    Parameters of variation with our products is highlighted clearly throughout our website, we take great care and use strictly monitored measures to ensure our products are within these parameters, however, because of the natural nature of our products, human error, machinery inconsistencies and unforeseen errors sometimes our products may not fall within the parameters stated.   

 

Delivery

6.1.    Lead time on all retail orders is typically two to four days. The lead time on wholesale orders varies because it is dependent on the quantity or products ordered.

6.1.1.    Lead times may extend during busy periods.

6.2.    Logwise Local deliveries may be at any time on any day with arrangement between you and us.

6.3.    Some Logwise Local deliveries may be tipped out of a bulk bag or left in a bulk bag. This cannot always be decided on delivery and should be clearly stated by you when you order.

6.4.    The rest of the points in this section relate only to non Logwise Local deliveries.

6.5.    All retail pallet deliveries are delivered on an economy service, which is a two-day service.

6.6.    Delivery is free on all retail orders to the UK mainland, excluding the Scottish Highlands.

6.7.    Delivery to areas outside of our free delivery area may have a delivery surcharge or may be cancelled by us.

6.8.    Delivery time can be anytime between 8am and 8pm.

6.9.    Standard two-day pallet delivery is free to the UK mainland (excluding Scottish Highlands). Saturday delivery is available.

6.10.    Access requirement: most of our orders require pallet delivery, the pallet is moved from the delivery vehicle using a pallet pump truck pushed by hand. These pump trucks cannot operate over gravel or grass.

6.11.    National pallet delivery is made using our third-party haulier, using a 7.5-ton truck, or bigger, with a tail lift. Your goods are delivered on a pallet and left as close to your front door or log store as possible.

6.12.    For delivery of smaller products – for example kiln dried kindling and eco-firelighters – we use a two to three-day courier service.

6.13.    Saturday deliveries can be requested for both AM and PM time slots. The cost of this service is charged at the prevailing rate per pallet. For a Saturday delivery your order must be placed no later than Wednesday – any orders requesting a Saturday delivery that are placed on a Thursday or Friday they will be delivered on the Saturday of the following week.

6.14.    We shall do everything we can to ensure the courier will call you to arrange a delivery date and time, but the courier/delivery driver may not do this because of reasons beyond our control, and so we cannot guarantee this will happen.

6.15.    It is your responsibility to clearly state where your order can be left in the case of no-one being at the delivery address. For online orders this can be done in the “Delivery instructions” box and verbally when ordered over the phone.

6.16.    In the event of you agreeing to a delivery and not able to accept the delivery because you are not at the arranged delivery address, or there not being a safe place to leave the goods, a redelivery charge of £20.00 per pallet may be made.

6.17.    In the event of a delivery not being possible due to poor access or gravel drive then the delivery will have to be “kerbside” (i.e. left as near to the property as possible). If this is still not possible on the day, a re-delivery charge of £20 may be imposed.

6.18.    All goods must be checked on arrival and delivery paperwork signed unless prior agreement has been made with the delivery company to leave the goods at the property at which point these will be left at the customer’s risk.

6.19.    Once the goods are delivered the pallet on which the product is delivered automatically becomes the property of the purchaser.

6.20.    Any delivery issues must be reported immediately to Logwise Firewood.

 

Cancellations

7.1.    We reserve the right to cancel any order at any time.

7.2.    If you are a consumer then for products bought online, you have a legal right to change your mind within 14 days, in which case you are responsible for the costs of return of any goods as well as adequate insurance for the goods’ return.

 

Errors

8.1.    We regularly check all information on our website; in the unlikely event of some content being inaccurate or misleading we advise you to independently confirm any information contained in the website before acting on it.

8.2.    In the case of an error or omission on the website, we reserve the right to amend or cancel any order, interaction or details regarding to the error in order to resolve the issue.

8.3.    Our correspondence with you — written or verbal — including, statements or declarations describing our goods and serviced are not immutable and so are not binding to our contract with you.

8.4.    Our wholesale invoices describe the products supplied and prices at the time of creation, these can change without notice due to errors and product changes such as price, packaging, volume and haulage.

9.1.    Logwise Firewood is a trading name for Logwise, a registered company in England and Wales.

9.2.    Logwise’s registered business office, processing yard, storage sheds, workshop and packing shed is at Lee Mires farm, Sawley, Ripon, North Yorkshire, HG4 3EN.

Payment card security

10.1.    Logwise complies with the Payment Card Data Security Standard (PCI DSS). This is provided by Barclays Bank PLC and ensures that Logwise Firewood uses proactive security practices and software to keep all payment card details secure.

 

Product replacement.

11.1.    In the occurrence of a product being out of stock we may replace this with a like for like replacement.

11.2.    In the case of hand-made products, we do our utmost to supply products as they are presented on the website, but these may vary slightly in aesthetics, design and size due to the natural products being used and the hand-made production process.

 

Moisture Content

12.1.    We do our very best to produce the best quality firewood we can and try to get the moisture content of our logs as low as possible. However, this will vary because of the natural aspect of our products, variants in atmospheric conditions and position of the logs in their storage container. This applies to all our firewood products.

12.2.    Our kiln dried logs are dried to an average moisture content of, typically, less than 20%. This means the average of the order provided by us. Some of our kiln dried logs will have a much lower moisture content than this, while others may have greater because of their size, species, atmospheric conditions and storage location.

Price

14.1.    Every effort is made to ensure all the prices we advertise our products for are correct, however in the event the price advertised is incorrect we will change it to the correct amount before we dispatch your order.

14.2.    Wholesale prices do not include VAT which will be applied and invoiced.

14.3.    Retail prices include VAT at the applicable rate, this can be 20% or 5%.

14.4.    In the event of the VAT rate changing from the date you place your order and the date we deliver your order we will change the VAT rate unless you have already paid for the order in full.

 

Payment

15.1.    Payment is due when your order is placed.

15.2.    If you have paid a national price for a Logwise Local delivery we will reduce the product/s to the Logwise Local price at our discretion.

15.3.    Payment is taken online using PayPal, all major credit cards are accepted. If you are unsure, please contact us.

15.4.    No goods are left at your delivery address until full payment has been received. Sometimes payment can be accepted on delivery with cash or cheque or BACS, in which case an invoice will be left.

15.5.    All goods remain the property of Logwise Firewood until paid for in full.

15.6.    If you see a problem with the amount, we have charged you please contact us immediately and we will seek to resolve the issue as soon as possible.

15.7.    If you are unhappy with the quality of the goods we have provided we are under no responsibility to offer you a reduction in price by way of a part-refund.

 

Product Liability

16.1.    The legal definition of ‘fault’ at the time of sale is to be used whereby injury to the consumer is caused by a product fault,

16.2.    If you are a re-seller or not a consumer of the products supplied, you are responsible for all liability of the product/s.

16.3.    Logwise supply goods conforming with standard of the Consumer Protection Act 1987 (Consumer Protection Act). This implements the strict liability regime introduced by EU Directive 85/374/EEC on liability for defective products (Product Liability Directive).
